1. Scope of the Service

These Terms govern your use of the platform of Terra View Analysis (the “Service”), which enables:

• Upload of aerial and thermal datasets,
  
• Access to results via a web dashboard.
  

By creating an account or using the Service, you agree to these Terms.

2. User Eligibility

You may use the Service only if you:

• Are at least 18 years old, and
  
• Have the authority to bind the company or organisation you represent (if applicable).
  

3. User Responsibilities

You are responsible for:

• Ensuring that all aerial data have been collected in accordance with applicable aviation, UAV and privacy laws.
  
• Ensuring you have all necessary rights and permissions to upload the data.
  
• Keeping your login credentials confidential and notifying us immediately in case of suspected compromise.

We are not responsible for any legal consequences of unlawful flights or data collection conducted by you or on your behalf.

4. Use of the Service

You agree not to:

• Use the Service in a way that violates applicable law,
  
• Upload malicious code or attempt to interfere with the system,
  
• Access or attempt to access data belonging to other users.

We may suspend or terminate your access if we reasonably believe you are violating these Terms or compromising the security of the Service.

5. Intellectual Property

• The platform, software, logos, and underlying technology are owned or licensed by Terra View Analysis.
  
• You retain ownership of the data and files you upload and of the derived outputs, subject to any separate written agreement.
  
• You grant us a non-exclusive, worldwide, royalty-free license to process your data solely for the purpose of operating and improving the Service.
  

6. Fees and Payment

If fees apply:

• Pricing, billing terms and any additional conditions will be communicated separately (e.g. through proposals, order forms or service agreements).
  
• Unless otherwise agreed, invoices are payable within 14 days from the invoice date.

At this time, all commercial arrangements (pricing, invoicing, payment terms) are agreed directly in writing between Terra View Analysis and the client.

7. Limitation of Liability

To the maximum extent permitted by law:

• The Service is provided “as is” and “as available”.
  
• We do not guarantee that the outputs (orthophotos, models, analytics) are error-free or suitable for any specific legal, engineering or financial decision.
  
• We are not liable for indirect, incidental, special or consequential damages, loss of profit, loss of data or business interruption.

Our total aggregate liability arising out of or in connection with the Service shall not exceed the total amount paid by you to us in the twelve (12) months preceding the event giving rise to the claim, unless otherwise required by mandatory law.

8. Indemnity

You agree to indemnify and hold us harmless from any claims, damages or expenses arising out of:

• Your unlawful collection of aerial data,
  
• Your misuse of the Service, or
  
• Your violation of these Terms.
  

9. Termination

You may stop using the Service at any time.
We may suspend or terminate your account with reasonable notice where possible, or immediately in case of serious breach or abuse.

Upon termination:

• Your right to access the Service ends,
  
• We may delete or anonymise your data after expiry of applicable retention periods, subject to legal obligations.
  

10. Governing Law and Jurisdiction

These Terms are governed by the laws of Greece, without regard to conflict-of-law rules.
Any disputes shall be submitted to the competent courts of Greece, unless mandatory law provides otherwise.

11. Changes to the Terms

We may update these Terms from time to time. The most recent version will be published on https://terraviewanalysis.com/terms-conditions/ and will apply from the date of publication.
